Shopping regulationsSHOPPING REGULATIONS The online shop operating on the www.elmarco.pl website is run by the company ElmarCo Tadeusz Martyniuk entered in the Business Activiy Register kept by Sopot City Council under the number 12093, NIP (taxpayer’s identification number) 584 000 20 21, domiciled in Gdańsk, 14a Letniskowa Street. 1. The online shop sells goods on the internet. 2. Elmarco is obligated to provide the Client with essential data concerning its products:

6. Sales and sales promotion – Only limited number of products is vendible during sales and sales promotions. Therefore orders for those goods are filled according to the order’s placing order until the products being on sales/sales promotion are out of stock. 7. Due to production process and the diversity of materials and parts’ lots, Clients should be aware of slight differences that might occur in shades of stained elements (made of wood, glass or marble) of fittings from various production lots. Therefore it is crucial to point out during placing an order whether the goods should come from the same production lot. 8. Products displayed in ElmarCo’s online shop do not include any light source unless it’s distinctly indicated in products description. 9. An invoice is drawn up to each order after all the ordered goods are assembled and ready for dispatch. 10. In case of any delays of the shipment, ElmarCo Tadeusz Martyniuk will promptly inform the Client of the delay in order to arrange another date of the dispatch. 11. All prices are given in PLN (Polish zloty) and include VAT and are binding the moment of placing an order by the Client. The shop reserves the right to change prices of products that are on shop’s offer make changes in shop’s offer, conduct and withdraw sale’s promotions on shop’s website as well as make changes in them. The product’s delivery mode is chosen by the Client and is specified in a set order. Delivery costs. 12. Each product has a specified lead time (given in working days). An order consisting of products with different lead times will be filled after all the products are assembled i.e. after the longest lead time of ordered products. Ordered goods may also be collected personally in the ElmarCo’s Sales Department in Chwaszczyno, 2 Gdynska Street. 13. On the moment of collection / receiving the products the Client should:
14. Claims concerning assortment, quantity or damage occurred during transport have to be in writing sent by post (ElmarCo Tadeusz Martyniuk, ul. Gdyńska 2, 80-209 Chwaszczyno), by e-mail (sklep@elmarco.pl) or fax (+48 58 552 84 29) on the day of the delivery or the next day in compliance with the binding template of damage certificate (reclamation specimen). 15. In case of faulty goods, the Client has the right to receive the warranty services. A claim is examined within 20 days from the moment of receiving the claimed goods. In reasoned cases, the damaged product will be fixed or exchanged for a new one and if that is not possible, the Client will receive a refund in amount of claimed product’s price or will be offered other products available in the shop. The costs incurred by returning faulty goods are returned immediately once the parcel has been received and the claim has been examined. The Shop does not accept products sent by postal collection order. 16. Attention! Due to production process and the diversity of materials and parts’ lots, Clients should be aware of slight differences that might occur in shades of color even when purchasing several units of the same product. Varnishing may affect optically in various manner according to the angle of reflection. Slight differences in color are a sign of material’s veracity. Therefore claims on the color difference will not be accepted. In order to minimize the probability of occurring color differences it is crucial to point out during placing an order (by e-mail) whether the goods should come from the same production lot. Due to various characteristics of monitors and digital processing techniques, product’s pictures shown on the shop’s website may differ slightly from the reality. The differences between the real color of the product and the color shown on the website may not be a reason for lodging a complaint 17. The Client may choose between two modes of payment: - by transfer, - by credit card See payment details. 18. In accordance with the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product, the Client has the right to return their purchase without providing any reason within ten days of receiving the parcel. The goods must not be used nor damaged. To receive a refund, the Client is obliged to return the order together with the enclosed specification and cash register receipt. The shop guarantees a refund of the amount corresponding to the price of the goods. The refund will be made by a bank transfer to the account specified by the Client or by postal order sent to the address specified on the order. Delivery costs will not be refunded. 19. All products available from the shop are original, new and under the manufacturer’s warranty. 20. In accordance with the Act of 29 July 2005 on the used electrical and electronic equipment (Journal of Laws No. 180, item 1495) a Client buying electrical or electronic equipment has the right to return the same type of equipment to the shop where the new equipment has been purchased. ElmarCo’s Clients wanting to return the used equipment are kindly asked to send it to the address: ElmarCo Tadeusz Martyniuk ul. Gdyńska 2, 80 – 209 Chwaszczyno k/Gdyni. Delivery costs will not be refunded. 21. A sales agreement is concluded between the Client and ElmarCo Tadeusz Martyniuk. Preservation, security and access to the relevant provisions of the Agreement shall be concluded by printing and handing over the Client a fiscal invoice with the delivery. 22. A sales agreement is concluded in Polish and in accordance with the Polish Law 23. ElmarCo Tadeusz Martyniuk is committed to the personal data protection in accordance with the Personal Data Protection Act of 29 August 1997 (Journal of Laws No. 133, item 883 as subsequently amended). A Registered Client has the right to inspect and correct His or Hers data. At the Client’s request the data will be deleted. 24. The competent court for any disputes arising under the sales agreement is the court competent for the defendant domicile or the court competent for the sales agreement execution's place 25. In regards to all matters not settled herein, the regulations of the Civil Code and the Act of 31 March 2001 on the protection of certain consumer rights and on the liability for damage caused by a dangerous product shall apply (Journal of Laws No. 22, item 271).
